Farm to Chocolate Factory Program in Hawaii Travel Waiver

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

For: Wilmor Publishing Corp. carrying on business under the firm name and style of Ecole Chocolat (Ecole Chocolat)

ATTENTION: BY SUBMITTING THIS LEGAL DOCUMENT YOU GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY.

Assumption of Risks: I understand that my travel abroad to participate in the Courses will place me in an unfamiliar surrounding where I will be exposed to risks such that I may suffer physical injury, sickness or death, and/or damage to my person and my property. I understand that there is the possibility of violence and crime, civil unrest, and acts of terror which may arise or occur at places I visit during the Courses. I freely and voluntarily accept and assume all such risks, dangers and hazards, and I understand that Ecole Chocolat will not be able to ensure my safety at all times. I undertake to be responsible for informing myself as to all matters that may concern me during my participation in the Courses. I understand that Ecole Chocolat reserves the right to alter the itinerary for the Course(s), and/or cancel the Course(s) for any reason including too few participants, and logistical problems such as strikes, military actions, acts of God, or any other circumstances which the directors and officers of Ecole Chocolat, in their sole discretion, think would make the trip inadvisable. In the event of any such alteration or cancellation, I agree that Ecole Chocolat cannot be held responsible for any resulting loss that I may incur.

Assumption of Responsibility: I understand that it is my responsibility to abide by all applicable Ecole Chocolat and host institution policies, and the laws of the host country and to ensure that I have adequate medical, personal health, dental and accident coverage, as well as protection of my personal possessions. More particularly, I understand that Ecole Chocolat does not carry accident or injury insurance for my benefit and that there may be certain matters for which I may be held at fault personally if the accompanying circumstances do not relate to or arise from the Courses or if my activities or my conduct falls short of what would be considered reasonable in the circumstances. In these cases I agree to be accountable in all respects for my own actions or inactions and any consequences resulting therefrom and not to ask Ecole Chocolat or its directors and officers to bear any liability in respect thereof; further I agree to be responsible for any claims made against Ecole Chocolat in relation to such actions or inactions and to indemnify Ecole Chocolat for any costs, charges or expenses, including legal fees, that it may incur as a result of any claims in respect thereof made against it. I agree that I will be fully responsible for all costs and expenses which may be incurred in providing any special services to myself, outside of regular services agreed to or provided by Ecole Chocolat in connection with the Courses, and without limiting the generality of the foregoing, I agree to be responsible for and to pay for all and any costs of rescues, special travel, medical attention or other special outlay for myself personally, and to reimburse Ecole Chocolat for all costs of these services as may be incurred by them for my benefit or at my request.

Liability Waiver: I waive any and all claims I may now and in the future have against, and release from any and all liability and agree not to sue Ecole Chocolat, its officers, directors, employees, instructors, leaders (voluntary or other), representatives and agents for any loss, damage, injury or expense that I may suffer as a result of my participation in the Courses, due to any cause whatsoever, including without limitation negligence, accidents, theft, terrorism, acts of God, war, civil unrest, sickness, transportation, scheduling, travel delays, cancellations, and government restrictions or regulations. I agree that any visual image products, including without limitation photographs, produced by Ecole Chocolat as a result of the Courses, are the property of Ecole Chocolat, and may be used by Ecole Chocolat in any publications for the purposes of advertising, whether or not such visual image products contain an image or likeness of myself.

I understand that this agreement cannot be modified or interpreted except in writing and that no oral modifications or interpretations shall be valid. This agreement shall be effective and binding upon my heirs, executors, administrators, successors and assigns. I have read this document carefully and I fully understand its terms. I understand that I have given up substantial rights by submitting it, and I have submitted it freely and voluntarily without any inducement, assurance or guarantee being made to me.
